Content Sharing Terms and Conditions

By giving your consent for us to share your photo(s) featuring our product(s), you are agreeing to our Terms and Conditions. This gives Alpine Spas Ltd permission to share your photo on any Alpine Spas Ltd owned social media platforms (including but not limited to Instagram, Facebook and Pinterest), website and other marketing channels and grants Alpine Spas Ltd a non-exclusive, perpetual, irrevocable, assignable Licence to use the photo in this way.

From time to time, the Alpine Spas Ltd marketing department, along with any of our authorised service providers, select content from third party platforms (“user-generated content”) to use in the promotion of our products through Alpine Spas Ltd marketing activities. The content selected by us will be used in accordance with these terms and conditions. It is not necessary for you to purchase anything from Alpine Spas Ltd to contribute to Alpine Spas Ltd media and marketing.

What am I agreeing to?

By consenting to our terms and conditions, you acknowledge that your content may appear in Alpine Spas Ltd marketing collateral for advertising purposes. You retain the legal ownership of any photo you give your consent for Alpine Spas Ltd to share, but you do give permission for Alpine Spas Ltd to use the photo on Alpine Spas Ltd webpages and in Alpine Spas Ltd advertising, marketing and promotional materials, without compensation or prior notice using any media or distribution methods.

Alpine Spas Ltd may use, edit, alter, reproduce, translate, publish, or create derivative works at our sole discretion.

You accept we may choose not to use your content or to remove your content from Alpine Spas Ltd media and marketing at any time.

You agree that you will not receive any payment or any other remuneration if we use your content in this way.

You also grant Alpine Spas Ltd the right to use your first name, image, likeness, caption or other identifying information in connection with the use of any of your photos displayed on our web pages. We will only use personal information supplied by you for the purposes of posting your content, unless you provide your consent for us to use your personal information for any other agreed purposes. By agreeing to these Terms and Conditions, you are consenting to Alpine Spas Ltd collection and processing of your personal data as described in Alpine Spas Ltd Privacy Policy.

By giving your consent, you warrant and represent that (i) you own the rights to the photo or, if the photo is subject to third party rights, that you have all required licenses, rights, consents and permissions to publish the photo and grant the necessary rights, and (ii) you are over 18 years of age. To the extent permitted by law, you also agree to waive your moral rights in relation to any photos uploaded.

Third-party sites

Your consent also gives permission for Alpine Spas Ltd to upload the photo to our Image Bank, a section of our website accessed and downloaded from by third party users, such as the press and online bloggers. In agreeing to our use of your images in this way, you acknowledge that these third party users may use your images across their social media, websites and publications (print and online).

Please also note, while Alpine Spas Ltd can remove photos from the Alpine Spas Ltd website, Alpine Spas Ltd is unable to, nor is Alpine Spas Ltd responsible for, the removal of any photos shared or posted by third parties on third party sites which are not under Alpine Spas Ltd control.

If you wish to report a photo shared on a third-party site, you should contact the third party or third-party site directly.

If you do not wish to have your content used in this way, but you agree for us to use your images on our own platforms, please specify this in your response. If you simply say you agree, we will register this as consent for both parts of this agreement.

Alpine Spas Ltd Image Library Terms of Use

Images from the Alpine Spas Ltd image library may only be used to market Alpine Spas Ltd products. Unless you are a trade partner, it is not permitted to use any image without explicitly mentioning Alpine Spas Ltd and the other team members listed on the image file.

Images must not be distributed to a third party. The person, company or organisation downloading the image is responsible for ensuring compliance with the [Terms of Use].

It is a breach of copyright / against our [Terms of Use] to reproduce any image from this library, for personal or commercial projects.

What happens if I have a complaint about a photo or want a photo removed?

If you decide that you do not want this photo to be shared on our social media channels, then you can let us know by sending an email to marketing@alpinespas.co.nz and we will remove this photo.

Once we have received your email requesting removal of content, we will review your request and if agreeable, we will remove your content from Alpine Spas Ltd marketing within a reasonable timeframe.
